Terms and Conditions

Scope

These General Terms and Conditions apply to all orders placed by consumers through the Dancing Cat online shop.

A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their self-employed professional activity.

Offer and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

By clicking the order button, the customer places a binding order for the goods contained in the shopping cart.

The contract is concluded as soon as we confirm the order by email.

Prices and Shipping Costs

All prices are final prices. Pursuant to Section 19 of the German VAT Act (UStG), no VAT is charged or shown.

In addition to the stated prices, shipping costs may apply. These are clearly displayed during the checkout process.

Delivery

Delivery is made to the shipping address provided by the customer.

Delivery times are stated in the online shop.

If not all ordered products are in stock, we are entitled to make partial deliveries, provided this is reasonable for the customer.

Payment

Payment is made using the payment methods offered in the shop, in particular:

PayPal

The payment method is charged immediately after completion of the order.

Retention of Title

The goods remain our property until full payment has been received.

Right of Withdrawal

Consumers have a statutory right of withdrawal.

Return Conditions

In addition to the statutory right of withdrawal, the following conditions apply:

The items must be unworn and unused
They must be in their original condition
All labels must be attached

For hygiene reasons, returns of worn or used items may be excluded to the extent permitted by law.

Warranty

The statutory warranty rights apply.

Liability

We are fully liable for damages resulting from injury to life, body or health.

For other damages, we are liable only in cases of intent or gross negligence.

In the event of a breach of essential contractual obligations, also known as cardinal obligations, we are also liable in cases of simple negligence, but limited to the foreseeable damage typical for this type of contract.

Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

Final Provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

If individual provisions of these Terms and Conditions are invalid, the validity of the remaining provisions shall remain unaffected.
